General Terms and Conditions for Online Sales

General Provisions These conditions are exclusively valid between the ASSOCIATION OKUBO STATION, with its registered office in Florence, Italy, at Via del Ponte Sospeso 24R, and any person making online purchases on the website www.florencepopsorchestra.it hereinafter referred to as the “CUSTOMER”.

These conditions may be subject to changes, and the date of their publication on the website is equivalent to the date of entry into force. These conditions govern purchases made on the website https://florencepopsorchestra.it, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014 and Legislative Decree no. 70/2003 concerning electronic commerce.

ARTICLE 1 – Object of the Contract Through these general terms and conditions of sale, the ASSOCIATION OKUBO STATION sells and the CUSTOMER purchases tickets for national and international events indicated and offered for sale on the website https://florencepopsorchestra.it.

The contract is concluded exclusively through the internet, by the CUSTOMER accessing the address https://florencepopsorchestra.it and placing an order in accordance with the procedure provided on the website. The customer agrees to review these general terms and conditions of sale before confirming their order and to accept them by checking a box provided for this purpose. In the order confirmation email, the CUSTOMER will also receive a link to download and archive a copy of these general terms and conditions of sale, as required by Article 51(1) of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

ARTICLE 2 – Pre-contractual Information for the Consumer – Article 49 of Legislative Decree 206/2005 The CUSTOMER declares that, before concluding the purchase contract, they have full awareness of the goods illustrated and the subject of their purchase, and also declare themselves fully informed of: – the total price of the goods, including taxes; – payment methods; – the conditions, terms, and procedures for exercising the right of withdrawal (Article 6 of these conditions), as well as the standard withdrawal form provided in Annex I, Part B of Legislative Decree 21/2014;

ARTICLE 3 – Conclusion and Effectiveness of the Contract The sales contract is considered concluded when the ASSOCIATION OKUBO STATION sends an order confirmation email to the CUSTOMER. The email contains the CUSTOMER’s data and order number, the price of the purchased goods, and a link to print and archive a copy of these terms and conditions. The CUSTOMER agrees to verify the accuracy of the personal data contained in it and to promptly communicate any corrections to the ASSOCIATION OKUBO STATION. The CUSTOMER acknowledges that, despite the ASSOCIATION OKUBO STATION’s efforts to describe and present the items sold on the website as accurately as possible, some errors, inaccuracies, or small differences between the website and the actual product may occur. Additionally, the product photographs presented on www.creativestation.it do not constitute a contractual element, as they are purely representative.

ARTICLE 4 – Product Availability Product availability refers to the actual availability at the time the CUSTOMER places the order. However, this availability should be considered purely indicative because, due to the simultaneous presence of multiple users on the site, products may be sold to other CUSTOMERS before the order is confirmed. Even after the ASSOCIATION OKUBO STATION sends the order confirmation email, cases of product unavailability may occur. In this event, the order will be automatically adjusted by removing the unavailable product, and the CUSTOMER will be promptly informed by email; If the CUSTOMER requests the cancellation of the order, thereby terminating the contract, the ASSOCIATION OKUBO STATION will refund the amount paid within 14 days from the day it became aware of the CUSTOMER’s decision to terminate the contract, excluding concert tickets that will not be refunded.

In case the conceto is postponed due to force majeure on the part of the organization, a refund can be requested no later than the initial date of the concert.

ARTICLE 5 – Payment Methods The CUSTOMER’s payment can only be made using the credit cards indicated on the website https://florencepopsorchestra.it, by bank transfer, or through the PayPal payment method. In the case of payment with PayPal, the actual charge will occur when the ASSOCIATION OKUBO STATION sends the order confirmation email. Communications regarding payment and data provided by the CUSTOMER at the time of payment are transmitted over secure lines. The security of credit card payment is guaranteed through VBV (Verified by VISA) and SCM (Security Code Mastercard) certification.

ARTICLE 6 – Prices All product prices listed on the website https://florencepopsorchestra.it are expressed in Euro and include VAT where not otherwise indicated. The CUSTOMER accepts the right of the ASSOCIATION OKUBO STATION to change prices at any time; however, products will be invoiced based on the prices listed on the website at the time of the order and indicated in the confirmation email sent by the ASSOCIATION OKUBO STATION to the CUSTOMER. In the event of a computer, manual, technical, or any other type of error that could lead to a substantial change, not foreseen by the ASSOCIATION OKUBO STATION, in the public sale price, making it exorbitant or clearly derisory, the purchase order will be considered invalid and canceled, and the amount paid by the CUSTOMER will be refunded within 14 days from the day of cancellation.

ARTICLE 7 – Right of Withdrawal The ASSOCIATION OKUBO STATION reserves the right to cancel and/or modify event times and dates at its discretion and/or due to force majeure. For the event named WORKSHOP, the ASSOCIATION OKUBO STATION will refund within 14 days from the event cancellation date.

In the case of the event named CONCERT, the consumer acknowledges that if the contract concerns the supply of products and services related to leisure time, such as ENTRANCE TICKETS (tickets), for which the supplier undertakes to provide these at a specific date or during a specific performance period, THE RIGHT OF WITHDRAWAL under Article 52 of the Consumer Code DOES NOT APPLY.

The OKUBO STATION ASSOCIATION is not responsible for, nor will it provide any reimbursement for, travel expenses, lost deposits or any other expenses incurred as a result of registering for the event.
Each participant assumes responsibility for any additional expenses they incur by registering to participate in our events.

In accordance with the legal provisions in force, the CUSTOMER has the right to withdraw from the purchase without any penalty and without specifying the reason, within 10 days before the start of the event except for concert tickets.
In case of exercising the right of withdrawal, the OKUBO STATION ASSOCIATION will refund the amount of the products subject to the withdrawal within a maximum period of 14 days from the date of the withdrawal request.
The OKUBO STATION ASSOCIATION is not responsible for, nor will it provide any reimbursement for, travel expenses, lost deposits or any other expenses incurred as a result of registering for the event.
The OKUBO STATION ASSOCIATION assumes no responsibility for disservices attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disservices of the internet network, in the event that it is unable to execute the order.

The CUSTOMER who intends to exercise the right of withdrawal must communicate this to the OKUBO STATION ASSOCIATION by means of an explicit declaration, which may be sent by registered mail.
The CUSTOMER may exercise the right of withdrawal by sending, by registered mail, any explicit declaration containing the decision to withdraw from the contract or alternatively transmit the standard withdrawal form, referred to in Annex I, part B, Legislative Decree 21/2014 (not mandatory) whose text is reported below:

ARTICLE 8 – Access to the site
The CUSTOMER has the right to access the site for consultation and making purchases. No other use, especially commercial, of the site or its contents is permitted. The integrity of the elements of this site, whether audio or visual, and the related technology used remain the property of the OKUBO STATION ASSOCIATION and are protected by intellectual property rights.

ARTICLE 9 – Cookies
The website https://florencepopsorchestra.it uses “cookies”. Cookies are electronic files that record information relating to the CUSTOMER’s navigation on the site (pages consulted, data and time of consultation, etc.) and which allow the OKUBO STATION ASSOCIATION to offer a personalized service to its customers.

ARTICLE 10 – Integrality
These General Conditions of Sale are made up of all the clauses that compose them. If one or more provisions of these General Conditions of Sale are considered invalid or declared as such pursuant to law, regulation or following a decision by a court having jurisdiction, the other provisions will continue to have full force and effect.

ARTICLE 11 – Applicable law and competent court
These General Conditions of Sale are subject to Italian law. Any dispute that cannot find an amicable solution will be subject to the exclusive jurisdiction of the Court of FLORENCE. In any case, it is possible to optionally resort to the mediation procedures referred to in Legislative Decree 28/2010, for the resolution of any disputes arising in the interpretation and execution of these conditions of sale.
